Hey ladies, want to go topless around NYC this summer? Go right ahead! Police have been specifically told not to take any action against women who choose to show their breasts in the city, so long as there is no crude or sexual act being done with it.
Even if the topless display draws a lot of attention, officers are to “give a lawful order to disperse the entire crowd and take enforcement action” against those who do not comply. “Whether the individuals are clothed is not a factor in making a determination about whether the above-mentioned crowd conditions exist.”
This actually stems from a law created in New York over 20 years ago, where the state’s highest court ruled that baring one’s chest in public for noncommercial activity is perfectly legal for a woman, as it is for a man.
